A contest "Hass" to have rules, doesn't it?

So here are ours.

NO PURCHASE NECESSARY

1. Promotion Period: The “It has to be Hass” Video Contest (the “Contest”) begins at 10:00:01a.m. ET on April 7, 2008 and ends at 11:59:59 p.m. ET on June 6, 2008 (“Promotion Period”).

2. How To Enter The Contest:

1) During the Promotion Period, you may enter online by visiting www.hasstv.com (“Contest Website”), and following the onscreen instructions.

2) Upload an original video (maximum of 60 seconds) that shows us why you love Hass Avocados from Mexico. It can be any creative style you like - Documentary, reality-tv, cooking segment, story, or other. It's up to you. Here are some themes to think about to get you started. Or, you can come up with your own theme to tell people why "It has to be Hass" (Avocados from Mexico):

  • Make a convincing presentation of the attributes and qualities for why it Has To Be Hass.
  • Why It has to be Hass Avocados from Mexico: What you, a friend, chef, or relative love about avocados.
  • Cookin' with Hass Avocados from Mexico: Maybe turn a camera on a chef, yourself or a friend preparing and serving your favorite dish, salad, sandwich or dip using Hass Avocados from Mexico.
  • Now That's Versatility: How many ways can you think of to use Hass Avocados in a dish?
  • Guac Rocks!: Why guacamole is the life of the party.
  • Your best "Guac" moment ever: (a date, watching the Big Game, out with friends).
  • Make a TV commercial-style video. Maybe you've seen the cool "Bikers" commercial for Hass Avocados from Mexico. Click here to see it now.
  • Docu-style: film friends who love avocados.
  • Make up a story (falling in love, saving the dinner party), compose a rap song, or monologue about avocados. (We've even seen a poem about them).


    Video Guidelines:
  • Your video must not exceed 60 seconds.
  • Your video must be no larger than 10MB in size.
  • Your video must be in one of the following formats: .mpeg (.mpg4), .avi, .mov or .wmv.
  • Recommended resolution of 320x240.
  • Your video must include the Hass Avocados from Mexico Logo.
  • Your video must mention Hass Avocados from Mexico.
  • Your may only use the music provided on the tools page in your video.
  • Your video may not have been previously posted where it has been viewable by the public.
  • Your video will be judged upon the criteria outlined in rule #3.
  • You must also include the email addresses of all people who appear in the video on your Entry. There is a limit of ten (10) people who may appear in the video. In the event that you are determined a winner, all those people who appear in your video will also be contacted.
  • All persons depicted in your video must be 18 years of age or older as of the date of your entry to enter into the Contest. You and such other person(s) must attest that you and such person(s) have read, understood and agreed to these Official Contest Rules.
  • Submitted videos will be posted on the Contest Website after they have been screened by Administration.
  • If your video is not posted within 2-4 days from when you upload, you have not complied with the Official Rules.  Please re-read the rules, make appropriate adjustments to your video and resubmit.
  • All eligible entries (as determined by Sponsor) will be posted on the Contest Website through the conclusion of the Promotion Period.
  • Limit one entry per person.

By entering, you understand your video may be posted online by Horizon Media at www.YouTube.com following posting at www.hasstv.com. Posting will not be immediate; there may be a short period of time between video submission and posting. Any video deemed inappropriate or unsuitable for posting, in Sponsor’s sole discretion will be disqualified and will not appear on the Contest Website.

Entry Material or portion thereof that is, in the Sponsor’s sole discretion, shall not contain, include or involve any of the following:

  • Obscene, profane, lewd, defamatory content, data or images unsuitable for broadcast
  • Crude, vulgar or offensive pictures, depictions, images, language gang signs and/or symbols
  • Gratuitous violence, gun or other imagery or gestures of weapons Nudity
  • Explicit, graphic or sexual activity
  • Commercial products such as clothing, toys, food (with the exception of Hass Avocados or avocado recipes) and/or their trademarks, brands, logo or endorsements
  • No music of any kind
  • Hard liquor use or product images
  • License plates, phone numbers, personal addresses (physical or email ) or otherwise
  • Website or web page links
  • Illegal drug or alcohol use or abuse
  • Derogatory characterizations of any ethnic, racial, sexual or religious groups, humiliate other people (publicly or otherwise), any assault or threatening of others
  • Trespass or the violation of other people’s rights or property
  • Illegal (discriminatory, harassing) or inappropriate activity, behavior or conduct (i.e, inflicting emotional distress)
  • Conduct or activities in violation of these Official Contest Rules
  • Any other content, display, materials and/or images that is or could be considered inappropriate, unsuitable or offensive, as determined by Sponsor in its sole discretion
  • Any third party materials (including but not limited to music) that may otherwise violate or infringe (or may infringe) any of the following:

    Copyright, trademark, logo, mark that identifies a brand or other proprietary right of any person living or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity, or is otherwise objectionable, will not be considered and may disqualify the Entrant.

    Clothing worn in the video should not contain any visible logos, drawings, cartoons, phrases, trademarks or other third-party materials.

    All Entry Material must be suitable for broadcast as determined in the sole discretion of Sponsor.

    Entrants may not copy or otherwise plagiarize the Entry Material from any source.

  • No Entry Material shall contain any content or performance that has been broadcast or streamed, published or televised on television or as part of a recording of a motion picture film or television program.

  • Any digital video that is not of satisfactory quality (i.e. brightness, focus, volume) to be streamed online will likely be rejected, at Sponsor’s sole discretion.

  • Sponsor has the sole discretion to determine whether a video qualifies as an Entry. Any Entry not in compliance with the above and does not meet the Contest Website requirements will be disqualified.

  • Videos must be in keeping with Sponsor's image and may not be offensive, as determined by Sponsor in its sole discretion, nor can it defame or invade publicity rights or privacy rights of any person, living or deceased, or otherwise infringe upon any person's personal or proprietary rights. In such an event, the video will not be posted online and will be disqualified from the Contest.

All entries submitted become the property of the Sponsor and will not be returned. Normal Internet access and usage charges imposed by Entrants’ online service will apply. No information regarding entries or judging, other than as otherwise set forth in the Official Rules will be disclosed.

3. Judging: All eligible entries will be judged by a panel of judges determined by Sponsor, to determine one (1) Grand Prize winner, one (1) First Prize winner and twenty (20) Second Prize winners on or about June 23, 2008 on the basis of the following judging criteria:

  • Suitability for Promotions Purposes (25%)
  • Originality (25%);
  • Creativity (25%);
  • Integration of Hass Avocado key messages (Key Messages:
    “Smooth & Creamy”; “Versatile”;  “Easy to Use”) (25%)

In the event of a tie, tied entries will be rejudged by the judges based solely on Originality. Decisions of judges are final with respect to all matters relating to this Contest and all interpretations of these Official Rules by Sponsor is final. By participating, entrants agree to the Official Rules and the decisions of the judges.

4. Prizes And Approximate Retail Values (“ARV”):  One Grand Prize: $5,000, awarded in the form of a check, made payable to the entrant. One First Prize: Runner-up Prize: $2,500, awarded in the form of a check, made payable to the entrant. Twenty Second Prizes: Special Mention Prize: an autographed copy of Dos Caminos Mod Mex: Cooking Vibrant Fiesta Flavors at Home by Chef Scott Linquist and Joanna Pruess, an apron, and a Hass Avocados from Mexico HassCar Hero Card autographed by the drivers, Denny Hamlin and Kyle Busch. The ARV of each Second Prize is $40.00. The total ARV of all Contest prizes is $8,300. Prizes will be awarded (provided a sufficient number of eligible entries are received) and winners notified by phone, mail and/or e-mail. Prizes are not transferable. No prize substitutions are allowed. Taxes related to the prize are the responsibility of the individual winners, and each winner will be required to provide his/her social security number for tax purposes.

5. Eligibility: Open only to legal residents of the 50 United States and the District of Columbia, who are 18 years of age or older as of date of entry. Employees of Hass Avocados from Mexico (“Sponsor”), their affiliates, subsidiaries, advertising and promotion agencies, their immediate family members and/or those living in the same household are not eligible. This offer is void wherever prohibited and subject to all federal, state and local laws.

6. General Rules: Potential Grand and First Prize winners (and those that appear in winning videos) will be required to sign and return an Affidavit of Eligibility, liability/publicity release (where legal) and assignment of rights within ten (10) days of notification attempt or prize will be forfeited and alternate winner may be determined. If a winner is a minor in his/her state of residence, prize will be awarded in the name of parent or legal guardian, who will be required to sign all documents, fulfill all required conditions as set forth in these Official Rules. Return of prize notification as undeliverable may result in disqualification and alternate determination. By participating in this Contest, entrants agree to be bound by the Official Rules and the decisions of the judges. The Sponsor and its agencies are not responsible for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in this Contest or by any human error which may occur in the processing of the entries in this Contest or for any liability for damage to any computer system resulting from participation in, accessing or downloading information in connection with this Contest. The Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Contest or web site; violates the Official Rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If, for any reason, the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, then the Sponsor reserves the right at its sole discretion to cancel the Contest and determine the winners from among all eligible entries received prior to cancellation and in the event of the cancellation, the winners will be determined by Sponsor’s designated judges, based on the same criteria listed above.

7. Release: By entering the Contest, you and all those depicted in your video, as appropriate, hereby grant the Sponsor, YouTube, Inc., their affiliates, subsidiaries, assigns, licensees, and legal representatives the irrevocable, perpetual, worldwide right to use, reproduce, edit, market, broadcast, store, distribute, have distributed, reproduce, re-arrange, change, add to or delete from, translate, adapt or otherwise revise and/or alter the video or blur or distort any person, place or item depicted in the video, on any display thereof, publicly and privately display, communicate, publicly and privately perform, transmit, have transmitted, create derivative works based upon, and promote your video, for editorial, commercial, promotional and all other purposes. In addition, you and all those depicted in your video hereby assign to the Sponsor all royalty-free, non-exclusive rights, titles, and interests that you may be deemed to have in any reproduction, product, or derivative work using or incorporating the video. You represent and warrant that: (i) all rights to the video belong to you and the video does not and shall not infringe on any copyright or any other third party right nor violate any applicable law or regulation, (ii) you have the right to grant any and all necessary rights and licenses provided herein, including without limitation, all necessary copyright and other related rights to the video (including any approvals from those depicted in your video), free and clear of all claims and encumbrances without violating the rights of any person or entity, including any right to privacy or publicity, (iii) you and all those depicted in your video hereby hold the Sponsor harmless from and against any third party claim arising from use of the video and you waive any right to inspect or approve uses of the video or to be compensated for any such uses. In submitting an entry into this Contest, each entrant agrees to, confirms and represents to Sponsor that neither he/she nor anyone else has engaged or taken part in (or induced or encouraged anyone else to do so) in any activity or conduct in connection with this Contest that: (i) may or is likely to harm or create a risk of harm, physical or mental injury, emotional distress, death, disability, disfigurement, or physical or mental illness to any person, other living thing or any property; (ii) may or is likely to create a risk of any other loss or damage to person, living things or property; (iii) is or may constitute a crime, unlawful or non-consensual activities (e.g., conduct that could lead to criminal prosecution), tortuous conduct (e.g., conduct that could lead to civil prosecution) or the violation or infringement of the rights of any other party; or (iv) violates any of the terms or conditions of these Official Rules. Past experience has confirmed that contests and other competitions generate substantially similar submissions or entries, which closely resemble concepts and ideas that have been independently developed by Contest Entities before or after the Contest.  Accordingly, entrants may subsequently see a Contest Entity presentation, which seemingly incorporates an idea or concept or includes materials similar to that contained in their entries. Any similarity is purely coincidental and unavoidable in light of the volume of ideas which Contest Entities routinely consider in the course of their program development. Participating in the Contest constitutes permission to the Sponsor and its agencies to use participants’ names, biographical information, pictures/portraits, likenesses and/or voices and video, for purposes of advertising and trade without further compensation, unless prohibited by law. BY ACCEPTING A PRIZE, SPONSOR, YOUTUBE, INC., DON JAGODA ASSOCIATES, INC., THEIR AFFILIATES, SUBSIDIARIES, ADVERTISING AND PROMOTION AGENCIES, AND ALL OF THEIR RESPECTIVE SHAREHOLDERS, OFFICERS, DIRECTORS, EMPLOYEES AND ASSIGNS, MEMBERS, REPRESENTATIVES AND AGENTS, WILL HAVE NO LIABILITY WHATSOEVER FOR, AND WILL BE HELD HARMLESS BY WINNER FOR ANY LIABILITY FOR ANY INJURY, LOSS OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING DEATH, AND PROPERTY, DUE IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZE OR PARTICIPATION IN THIS CONTEST OR PARTICIPATION IN ANY CONTEST OR PRIZE-RELATED ACTIVITY. You hereby represent and warrant that you have read these rules and are fully familiar with its contents.

8. Winners’ List: The winners’ list will be available after July 21, 2008 at www.hasstv.com.

WHAT ARE HASS AVOCADOS FROM MEXICO?

You may love avocados and not be sure what a "Hass Avocado from Mexico" is. That's okay. Hass Avocados are a type of avocado. (Like the one in that director's chair on this page). They're pear-shaped and have green-black pebbly skin on the outside and a luscious green, smooth, and creamy flesh on the inside. They turn black as they ripen off the branch. Hass Avocados are the most widely consumed kind in the U.S., and Mexico is the largest producer of Hass Avocados in the world. They are extremely versatile and people use them in salads, sandwiches, wraps, sauces, dips, and of course, guacamole. Chefs love them, and you can find them in Latin, Asian, American, European and other cuisines from around the world.

HOW CAN I ENTER THE "IT HAS TO BE HASS" VIDEO CONTEST?

HOW MANY TIMES CAN I ENTER?

WHY DO I NOT SEE MY ENTRY ONLINE?

All eligible entries will be posted within two business days of submission. Any videos deemed inappropriate or unsuitable, in Sponsor's sole discretion, will be disqualified. See Official Rules for more details.

HOW WILL THE WINNERS BE DETERMINED?
